GST invoice is a commercial instrument that is required to be issued by a supplier of both goods and services to a recipient of the supply. Statutory Provision Related to GST Invoice

The provisions relating to GST invoices are provided under section 31 of the CGST Act, 2017 as well as under Chapter-VI: Tax Invoice, Credit and Debit Notes of Central Goods and Services (CGST) Rules, 2017. The provisions contained in the above rules have been incorporated at the relevant places.

The Government has also set a time limit within which registered persons shall have to issue the GST invoice for supplies made by them. The time for issuing an invoice would depend on the nature of the supply, whether it is a supply of goods or a supply of services. In the case of supply involving the movement of goods, the invoice should be issued before or at the time of the removal of goods. In case supply does not involve the movement of goods, the invoice must be raised before or at the time of delivery of supply.

In case of a registered person supplying taxable services, the tax invoice should be issued – at least before or after the provision of services, but within the specified period of 30 days (45 days – in case of Banking/Financial Institutions including Non-Banking Financial Companies - NBFC).

Format of GST Invoice and Mandatory fields

As per section 31 of the CGST Act, 2017 and rules made thereunder, there is no format prescribed for GST invoices, but as per Chapter-VI: Tax Invoice, Credit and Debit Notes of Central Goods and Services (CGST) Rules, 2017 make it mandatory for an invoice to have the following fields.

Few Important Points to Keep In Mind Regarding GST Invoices

In case of a supply in the course of inter-state trade or commerce, the place of supply along with the name of the State in which the supply is being made has to be mentioned in the GST Invoice.

In case the recipient is unregistered, and the value of the supply is more than Rs. 50,000 then the name and address of the recipient along with the address of delivery should be mentioned.

In case of taxable supply of goods, GST invoice should be prepared in triplicate. The original copy is to be given to the Recipient of the supply, the Duplicate copy is to be given to the Transporter (if any) and the Triplicate copy is to be kept by the Supplier.

In case of a taxable supply of service, the GST invoice should be prepared in duplicate. The original copy is to be given to the recipient of supply and the duplicate copy is to be kept by the supplier.

Penalty for Non-compliance under GST
